The controller of your personal data is Bartłomiej Pietrzyk, a sole trader operating under the business name 4digital Bartłomiej Pietrzyk, ul. Kożuchowska 8 lok. 4, 67-115 Bytom Odrzański, Poland, tax ID (NIP) 6941676247, owner of 4digital.cloud.
For anything concerning personal data, write to rodo@4digital.cloud. No data protection officer has been appointed; the law does not require one for this business.
4digital.cloud is a static informational website. It has no user accounts, no newsletter, no online sales and no forms that send data to a server.
Email correspondence
When you write to kontakt@4digital.cloud — directly or via the “Open an email” button on the site — I process the data you provide yourself: your email address, your name or organisation if you include them, and the content of the message. The button on the site only composes the text from the fields you filled in and opens it in your own email app, with “[4digital.cloud]” in the subject; the site neither transmits nor stores that text. The “Copy the text” button works entirely within your browser.
Server logs
The server hosting the site keeps standard access logs: IP address, date and time, the address requested and browser information. The logs are kept by the hosting provider OVH (OVH SAS, France) to secure and operate the service, for the period set in its terms for the hosting service. I do not copy the logs, keep them outside the provider’s panel or link them to correspondence.
What the site does not do
The site uses no cookies, analytics, advertising pixels, social plugins or embedded third-party content. Fonts and all assets are served from its own domain. Details are in the Cookie & Browser Storage Policy.
- Steps prior to a contract — where you write as the person who would be a party to the contract yourself (for example as a sole trader), replying to your enquiry and establishing the scope of an engagement are steps taken at your request prior to entering into a contract (Article 6(1)(b) GDPR).
- Other business correspondence — where you write as a representative of an organisation, or on a matter other than your own contract, the basis is my legitimate interest in conducting correspondence and handling enquiries (Article 6(1)(f) GDPR). The same basis covers justified retention of correspondence after a matter is closed.
- Retention of correspondence — until the matter is closed and, where no engagement follows, 180 days from the last contact, or 365 days in justified cases (where the matter requires returning to earlier findings). Messages from the site carry “[4digital.cloud]” in the subject and go to a separate folder, which I review manually once a quarter. Correspondence that did not lead to an engagement is deleted during the first quarterly review after 180 days from the last contact, or, in justified cases, after 365 days. There is no automated deletion.
- Performing the contract and meeting legal obligations — where an engagement follows: performance of the contract (Article 6(1)(b) GDPR) and tax and accounting obligations (Article 6(1)(c) GDPR), for the period required by law.
- Establishing, exercising or defending legal claims — the controller’s legitimate interest (Article 6(1)(f) GDPR), for the limitation period of such claims.
- Security and operation of the site — server logs; the controller’s legitimate interest (Article 6(1)(f) GDPR).
Providing your data is voluntary; without an email address I cannot reply. I make no automated decisions and do no profiling.
Recipients
Your data is processed on my behalf by OVH (OVH SAS, France) as the provider of the site’s hosting and of my email, under the data processing agreement that forms part of its terms of service. I do not sell data, share it for marketing purposes or pass it to other parties unless the law requires it.
Transfers outside the EEA
The site is hosted in OVHcloud data centres in France (per OVHcloud’s statement for its web hosting service: data remains under European jurisdiction). Email is a service of OVH SAS, registered in France, and its servers are located in France as well. I do not transfer data outside the European Economic Area myself. OVHcloud may, however, involve companies of its group established outside the EEA in operating its services (for example technical support); according to OVHcloud, such processing relies on the European Commission’s Standard Contractual Clauses concluded with those companies, with safeguards equivalent to the GDPR. I use no other providers outside the EEA.
Your rights
You have the right to access your data, to have it rectified or erased, to restrict its processing, to data portability, and to object to processing based on legitimate interest. Write to rodo@4digital.cloud.
You also have the right to lodge a complaint with the President of the Personal Data Protection Office in Poland (Prezes Urzędu Ochrony Danych Osobowych, ul. Stanisława Moniuszki 1A, 00-014 Warsaw, uodo.gov.pl).
Changes to this policy
If the way the site works changes — for example if analytics or a server-side form is added — I will update this policy before the change goes live. The current version is always available at this address.
